Online Sale – Right to Free Termination of Contracts (Returns) 

In accordance with the provisions of art. l) of paragraph 1, of article 4 of Decree-Law no. 24/2014, of 14 February, applicable to contracts concluded at a distance, it is informed that the consumer has the right to terminate the contract without incurring in any costs (except return costs) and without the need to indicate the reason, within 14 days from the day on which the person acquires physical possession of the goods, in the case of purchase and sale contracts.

Items must be returned upon presentation of the respective invoice and/or proof of payment and must be in perfect commercial condition, in the original packaging.

In cases of free Contract Termination, shipping costs related to the return are the responsibility of the consumer, as stipulated in paragraph 2 of article 13 of Decree-Law no. 24/2014, of 14/02.

The procedure for exercising the right is set out in articles 10 and 11 of Decree-Law no. 24/2014, of 14 February. In order to exercise your right to free resolution, you must communicate your decision to terminate this contract by means of an unequivocal statement (for example, a letter sent by post or email) to Milagre Lda, Rua da Paradela 388, 4510-362 S. For the free resolution period to be respected, it is sufficient that your communication regarding the exercise of the right to free resolution is sent before the end of the resolution period.

We make refunds using the same payment method used in the initial transaction, unless expressly agreed otherwise by you or technical unavailability of our services or third parties, in which case the refund will be made via bank transfer to IBAN to be indicated by the customer. ; in any case, you will not incur any costs as a consequence of such reimbursement.

We may withhold reimbursement until we have received the returned goods, or until you provide proof of dispatch of the goods, whichever comes first.

You must return the goods or hand them over to us, without undue delay and no later than 14 days from the day on which you inform us of the free termination of the contract. The deadline is considered to have been respected if you return the goods before the end of the 14-day period.

This return can be processed completely or partially.

 Return conditions for private customers

- Returns of the following products will not be accepted, as provided for in article 103 of Law 3/2014, of March 27, which approves the revised text of the General Law for the Protection of Consumers and Users and other complementary laws to be amended:

a) The provision of services, once the service has been completely executed, when the execution has begun, with the express consent of the consumer and user and acknowledgment on their part that they are aware that once the contract has If it has been fully executed by the entrepreneur, it will lose its right to return.

b) The supply of goods or the provision of services whose price depends on market fluctuations beyond the businessman's control, which may occur during the return period.

c) The supply of goods made according to the specifications of the consumer or user or clearly personalized.

d) The supply of goods that may deteriorate or expire quickly.

e) The supply of sealed goods that are not suitable for return for reasons of health protection or hygiene when opened after delivery.

f) The supply of goods that, after their delivery and taking into account their nature, were mixed together with other goods.

- Other products that are not among these exceptions can always be returned, when they are in perfect condition to do so. As a consumer, you are responsible for the decrease in value of the goods resulting from your handling, other than that necessary to establish the nature, characteristics and functioning.

- The product must be sent properly packaged to preserve its condition, thus avoiding deterioration of its presentation or permanent damage, using appropriate protective packaging; identified and sent duly sealed. Do not directly use the product box itself to make the return.

- If an item is part of a kit, packaging, including an offer or a gift, you must send all its contents, as it is essential for us to proceed with the refund.

- Once you have expressed interest in your return, we will send you instructions for shipping the product. You have to send it without delay, within the next 14 days.

- The transport costs arising from the return will be paid by you. You can choose the Transport Company that best suits your needs or choose to benefit from our rate and ask us to collect it.

- As soon as we receive the merchandise, and after checking the product/item, we will refund the amount. As always we will issue refunds within 14 days of receipt of the goods and, in principle, subject to the payment method selected at the time of purchase. Until we receive the products, we will withhold the refund.

- If these conditions are not met, Milagre Lda reserves the right to refuse the return.

Return conditions for companies

- As there is no law regulating reimbursement rights between companies, these procedures are governed under the terms of the company Milagre Lda.

- Empresa Milagre Lda only accepts the refund of goods received in perfect condition as they were sent and keeping all packaging and seals intact, during the 14 calendar days counting from the date of receipt. - The transport costs arising from the return will be paid by your Company.

- If these conditions are not met, Milagre Lda reserves the right to refuse the return.

- These conditions do not void the warranty or replacement of defective products.
